Whatever Happened to Judicial Restraint?

EJ Dionne calls the conservative wing of the Supreme Court “judicial activists”. He’s right. Talk of judicial restraint by conservatives was just that: talk.

To support the doctrine of judicial review is to support judicial activism. The differences are only in style and degree. But if we are to accept judicial review at all, surely we must hope that the Court would protect the First Amendment from McCain-Feingold.

That's the one decision I actually agreed with, but this Court has not shown any juridicial consistency. There are at least four complete hacks on the Court.
